This workshop is jointly sponsored by the APA Committee on Aging (CONA) and the APA Continuing Education Committee.

This intermediate workshop discusses three increasingly common areas of capacity assessment for those who work with older adults in private practice, long-term care and other settings: medical consent, independent living capacity, and financial capacity. Following a review of foundational knowledge, participants use case-based learning to identify practical approaches to capacity assessment of older adults.

Learning Objective 1
Define capacity as it is used in civil capacity assessment of older adults and delineate the key components of a comprehensive capacity assessment per the ABA-APA model

Learning Objective 2
Describe the general concepts about capacity in law, and specifically about capacity assessment in guardianship law and practice.

Learning Objective 3
Summarize key neurocognitive disorders of aging and how they impact capacity and delineate the role of memory, judgment and awareness in capacity functioning.

Learning Objective 4
List four legal standards for consent capacity and their application in a case.

Learning Objective 5
Describe a framework for evaluations relative to guardianship of person/independent living as well as sexual consent.

Define and distinguish financial capacity, financial exploitation and undue influence.

Learning Objective 7
Describe how to form a capacity opinion and how it differs from other clinical opinions and delineate what courts are seeking in written and oral testimony, especially in legal disputes.
