This workshop is the first of a two-part series on fundamental principles and emerging ethical issues in clinical practice. This workshop distinguishes among ethics, law, risk management, and clinical decision-making before reviewing research regarding the pattern and trends over recent years in complaints filed against practicing psychologists. A model for ethical reasoning is described and then demonstrated in application to “unprofessional conduct” and other common ethical complaints. This model is also demonstrated with an increasingly pressing emerging issue in clinical practice: professional competence and cultural competence in a global world.

Learning Objective 1
Distinguish among ethical, legal, risk management, and clinical decision-making issues that arise in clinical practice and articulate why it is important to correctly recognize what kind of issue is being presented.

Identify the most common professional ethics complaints against psychologists in recent years.

Presenter: Robert Kinscherff, PhD, JD  


Kinscherff Dr. Kinscherff is a clinical/forensic psychologist and attorney who currently serves on the administration and faculty at William James College.  He is also Senior Fellow in Law and Applied Neuroscience for a joint fellowship of Massachusetts General Hospital and Harvard Law School, and Senior Associate at the National Center for Mental Health and Juvenile Justice where he is involved in initiatives to support Juvenile Drug Treatment Courts for court-involved youth with co-occurring mental health and substance use disorders.  He is past two-term Chair of the APA Ethics Committee and has published and taught widely in ethics, law and professional practice.
